Terms of service
The terms for using FolioCam to document and share your work.
1About these terms
These terms govern your use of FolioCam, a jobsite photo and documentation service provided by FolioCam LLC ("we," "us," or "our"). "You" means the business using FolioCam and its authorized users.
By creating an account or using the service, you agree to these terms. If you use FolioCam on behalf of a business, you must have authority to accept them for that business. Our privacy policy explains how we handle personal information.
2Using FolioCam
FolioCam helps contractors capture and organize job photos, keep customer and job details together, share work, and create reports, estimates, and invoices. You must be at least 18 and use the service for lawful business purposes.
We give you a limited, non-exclusive, non-transferable right to use FolioCam while you comply with these terms. We retain ownership of the service and its software; your content remains yours.
3Your account and team
Use your own account and keep your email inbox and sign-in methods secure. Sign in with an emailed code or an available Apple or Google sign-in option. Contact us promptly if you suspect unauthorized access.
Your company’s owner manages invitations, roles, and seats. Your company is responsible for its users’ activity and for removing access when someone leaves. If you belong to more than one company, check which company you are working in before adding or sharing records.
4Plans and billing
- Solo: $20 per month for one user.
- Crew: $45 per month for up to three users.
Each additional Crew user above three costs $15 per month. Both plans include the same features. Prices are in United States dollars, before applicable taxes.
Subscriptions are purchased and managed on the website through Stripe. Billing is monthly in advance and renews automatically until canceled. Review the plan, purchased seat capacity, and any prorated charge or credit shown before confirming a change. Removing a teammate does not itself reduce purchased capacity.
If we change subscription prices, we will notify the owner at least 30 days in advance. The new price applies from the next renewal after that notice period. You can cancel before it takes effect.
5Cancellation and account closure
An owner can cancel through the billing page. Access continues through the paid subscription period. Payments are non-refundable, including unused portions of a month, except where required by law.
Cancellation or failed payment can make the company account inactive. Canceling a subscription does not immediately delete its records. Contact us before closing an account if you need help exporting or deleting data; we will explain the process and timing. See data retention for more information.
6Your photos and records
You retain ownership of the content you add to FolioCam. This includes photos, videos, customer details, job records, annotations, and documents.
You authorize us to host, process, resize, display, and deliver that content as needed to provide the service, including thumbnails, reports, and links you choose to share. You are responsible for having the rights and permissions needed to capture, upload, and share it.
We do not sell your content, use it for advertising, or use it to train AI models. The privacy policy explains the limited content sent to a provider when you use optional AI suggestions.
7Storage and uploads
FolioCam storage is intended for your company’s jobsite photos and videos. Any unlimited-storage offer applies to that use, subject to technical upload limits and reasonable protections against abuse. It is not a general-purpose archive or file-hosting service.
Offline captures wait on the device until they can upload. Check upload status before signing out, removing the app, clearing device storage, or replacing a phone. A file that has not uploaded may exist only on that device. Reopening the app may be necessary to resume uploads.
Keep separate copies of records essential to your business. If unusual or abusive use threatens the service, we may limit that use and will contact the owner where reasonably possible.
8Acceptable use
- Only upload and share content you are entitled to use. Respect customer privacy, property rights, and recording laws.
- Do not share sign-in credentials, resell access without permission, or access another company’s records without authorization.
- Do not upload unlawful or malicious material, interfere with the service, bypass access controls, or scrape private data.
- Do not copy or reverse engineer the software except where applicable law permits it.
- Do not misrepresent a photo, annotation, report, or recorded payment as independently verified by FolioCam.
10Photos, annotations, and reports
Capture details reflect information available from the device, including its clock and location readings. Imported files may have incomplete metadata. Device readings, job matches, and user-entered information can be inaccurate.
FolioCam documents your work. It does not certify when or where an event occurred, inspect workmanship, assess damage, or guarantee that a record will be accepted by an insurer, court, or other recipient.
Annotations, pin counts, labels, and before-and-after selections reflect a person’s choices. You are responsible for reviewing them and for the conclusions you draw from a photo or report.
11Location and suggestions
Location helps match photos to jobs. Signal quality, nearby addresses, and incorrect job details can affect the result. Review the selected job and correct filing when needed. Photos without a suitable match may need a job selected manually.
Optional folder, label, and description suggestions assist your work. Review a suggestion before accepting it; it is not a professional assessment or a guarantee of accuracy.
12Hiding and deleting photos
Hiding a photo removes it from ordinary photo views and future sharing or reports while retaining the file and a record of who hid it. Authorized users can restore it. Hiding does not change an issued document or a downloaded copy.
To request deletion rather than hiding, contact info@foliocam.com. We may need to coordinate with your company’s owner and preserve records required by law.
13Estimates and invoices
Estimates and invoices are your company’s business documents. You are responsible for quantities, pricing, tax rates, payment terms, customer details, and compliance with requirements that apply to your work.
- FolioCam does not provide accounting, tax, legal, or insurance advice.
- A manually recorded cash or check payment is your company’s record, not confirmation that FolioCam processed or verified it.
- A recorded customer response is not an electronic signature.
- Issued revisions are preserved. Corrections use a new revision instead of rewriting the document already issued.
Your FolioCam subscription pays for access to the app. It is separate from any amount your customers owe your business.
14Support
For help, email info@foliocam.com. We do not guarantee a particular response time.
Authorized support staff can use an audited, read-only account view to investigate issues. That view cannot change your company’s records. Our privacy policy explains staff access.
15Third-party services
FolioCam relies on hosting, authentication, payment, email, and other service providers. Your device, internet connection, and app store also affect availability. Their applicable terms may govern your use of those services.
See our service providers and third-party notices for more information.
16Service changes
We may update FolioCam to improve features, maintain security, or meet legal requirements. We will give the owner at least 30 days’ notice before materially reducing a core paid feature, except where an urgent security or legal need requires earlier action. You may cancel under section 5.
17Suspension or termination
We may suspend or end access for unpaid fees, material violations of these terms, abuse, or legal requirements. Where practical, we will notify the owner and allow a reasonable opportunity to resolve the issue.
Ending access does not erase amounts owed or obligations that should continue, including content rights, limitations of liability, and dispute provisions. Contact us about export or deletion of company records.
18Warranties and availability
FolioCam is provided as it is and as it is available. To the fullest extent the law allows, we disclaim every warranty that is not written into this agreement, including any implied warranty of merchantability, of fitness for a particular purpose, of title and of non-infringement.
We do not warrant that the service will be uninterrupted, timely, secure or error-free, that any defect will be corrected, or that any result obtained from using it will be accurate or reliable. We publish no uptime commitment and none should be inferred.
Some states do not allow some of these exclusions, so some of it may not apply to you. Nothing here limits any right you have that cannot be limited by agreement.
19Limits of liability
To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, or the cost of substitute services, whatever the theory and even if the possibility was known.
To the fullest extent the law allows, our total liability arising out of or relating to this agreement is limited to the amount your company paid us for FolioCam in the twelve months before the event giving rise to the claim.
These limits do not apply to your obligation to pay what you owe, to either party's liability for fraud or for death or personal injury caused by negligence, or to anything else that cannot be limited by law.
20Third-party claims
To the extent allowed by law, you agree to defend and indemnify FolioCam LLC against third-party claims and reasonable costs arising from your content, unlawful use of the service, or infringement of another party’s rights. We will promptly notify you of a claim and reasonably cooperate with the defense at your expense.
21Resolving disputes
Please contact info@foliocam.com first so we can try to resolve a concern. Both parties agree to attempt an informal resolution for 30 days before starting proceedings, unless urgent relief is needed or a legal deadline would be affected.
Unresolved disputes may be brought before a court with jurisdiction under applicable law. These terms do not impose mandatory arbitration or a class-action waiver, and do not limit rights that cannot lawfully be waived.
22Apple App Store terms
Where you downloaded FolioCam from Apple's App Store, the following applies, and it takes precedence over anything above that conflicts with it.
- This agreement is between you and us alone. Apple is not a party to it.
- We grant you a non-transferable licence to use FolioCam on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
- We are solely responsible for FolioCam and its content, and for any maintenance and support. Apple has no obligation to provide either.
- If FolioCam fails to conform to any applicable warranty, you may tell Apple and Apple will refund the purchase price, if any. Apple has no other warranty obligation, and any other claim about the app is ours to answer.
- We, not Apple, are responsible for any claim that FolioCam or your use of it fails to meet a legal or regulatory requirement, or arises under consumer protection or privacy law.
- We, not Apple, are responsible for handling any third-party claim that FolioCam infringes that party's intellectual property rights.
- You confirm you are not in a country subject to a United States embargo or designated as supporting terrorism, and that you are not on any United States list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
23Changes to these terms
We will update the date on this page when these terms change. For material changes affecting your rights or charges, we will notify the owner at least 30 days before they take effect, unless the law requires a different period. Continued use after the effective date means you accept the revised terms.
24Other terms and contact
These terms form the agreement governing the service. If a provision is unenforceable, the remaining provisions continue to apply. A delay in enforcing a right is not a waiver of it. Neither party is liable for a delay caused by events reasonably beyond its control.
You may not transfer this agreement without our consent, except as part of a sale of your business. We may transfer it as part of a sale or reorganization of FolioCam. No partnership, agency, or employment relationship is created.
Questions or legal notices: FolioCam LLC, info@foliocam.com. We send account notices to the owner’s email address.
